1.1 - Places must be reserved by sending a completed Registration form and a non-refundable deposit of 50% of the course cost (or 100% if booking within 14 days of the start date). Provisional bookings can be reserved for up to 1 week without a deposit. 1.2 - The balance of the course fee is payable 14 days prior to the course commencement date. 1.3 - In the event that the course fee is not paid in full 14 days prior to the course commencement date Shearwater Adventure Training reserve the right to treat the booking as cancelled by the client and re-sell the course place.

2. Cancellation by Client

2.1 - All cancellations must be made in writing. 2.2 - Once notified of the cancellation in writing, Shearwater Adventure will try to resell the course place(s). 2.3 - In the event that we are able to re-sell the course place prior to the commencement date of the course, the client will receive a full refund less 20% of the course cost to cover administration fees. 2.4 - Refunds will only be made after the commencement date of the course. 2.5 - In the event that Shearwater Adventure are unable to re-sell the course place prior to the course commencement date the client will be charged the following cancellation fees: • Your deposit (50% of the course fee) if the cancellation is made at least 14 days before the start date of the course unless Shearwater Adventure can resell the place (see point 2.3). • The full course fee if the cancellation is made less than 14 days before the course start date unless Shearwater Adventure can resell the place (see point 2.3). To cover this eventuality we recommend an insurance policy that includes cancellation or curtailment.

3. Cancellation by Shearwater Adventure

3.1 - Although every attempt is made to ensure that courses run as scheduled, in the event that Shearwater Adventure need to cancel a course due to unsuitable conditions or other unforeseen circumstances we will notify the client as soon as possible. 3.2 - Shearwater Adventure will notify clients not less than five days prior to a course start date if a course needs to be cancelled because a workable minimum number of participants have not been reached. 3.3 - Cancellation by us does not affect a client's right to a refund of travel costs that may have been incurred prior to the cancellation except in the circumstances set out in clauses 3.1 and 3.2. 3.4 - In the event of cancellation by Shearwater Adventure, clients will be offered the following options: • Full refund of the course fee paid or • Another course on different dates.
Whilst Shearwater Adventure maintain high professional standards of client care and safety, clients must realise and understand that participation in adventurous activities entails some risk of injury or death. Shearwater Adventure will at all times endeavour to minimise these risks through safe practices and procedures. However, these risks can never be entirely eliminated and participants accept that accidents and injury may occur. Shearwater Adventure is not under any liability whatsoever in respect of loss or damage to personal property not caused by the negligence of Shearwater Adventure or it’s representatives. When booking the course and signing the consent form, clients are accepting these risks and will be responsible for their own actions and involvement.
Shearwater Adventure holds full public liability insurance. However, clients are advised to seek their own personal and equipment insurance before commencing the course.
Due to environmental constraints, unsuitable conditions, client ability and factors out of our control, Shearwater Adventure reserve the right to amend, change or cancel programmes. This is to prevent placing clients or staff at an unacceptable risk level. Refunds for cancellations once a programme has started will be dealt with on an individual basis or covered under clause 3.4.
